Terms and Conditions

When placing an order with Tiered Kakes (“We,” “Us,” “Our”), you (“Client,” “Customer”) agree to these Terms and Conditions. Acceptance and payment constitute a legally binding agreement.

Tiered Kakes guarantees that orders will match the flavor, size, and general design described in the invoice. Minor variations in design, color, or appearance may occur. Any concerns must be reported at pickup or delivery.

All custom cakes are original works of art. Tiered Kakes reserves the right to exercise artistic discretion to ensure structural, visual, and creative integrity. Exact color matching cannot be guaranteed, and minor variations are expected. Major changes will be communicated before completion.

Orders are confirmed only upon receipt of the required deposit. Celebration orders under $150 require full payment at booking. Orders over $150 and wedding orders require a 50% deposit. All deposits are non-refundable and non-transferable. Final payment must be received by the invoice deadline. Non-payment may result in cancellation without refund or credit. Orders not secured with payment at least ten days before the event may be subject to a $75 rush fee.

All deposits and retainers are non-refundable. Clients may reschedule their event date for the same cake design within three months of the original date, subject to availability, and must request the change before the final payment due date or at least two weeks prior to the original date, whichever comes first. Changes to servings or design beyond the original cake are considered a new order. In such cases, the retainer may be applied as store credit toward the new order, and any additional balance is non-refundable.

Cancellations made more than two weeks before the event may receive store credit equal to the retainer, valid for 12 months. Cancellations within two weeks of the event are non-refundable, and retainers cannot be applied as store credit. Reorders using store credit will be priced at current rates.

All deliveries must be scheduled at the time of booking. Any special requirements of the venue must be disclosed before booking. If additional fees or costs arise from the venue, including but not limited to event day insurance, the Client is responsible for reimbursing Tiered Kakes for these out-of-pocket expenses.

Tiered Kakes is not responsible for any damage to the cake after setup is complete. Clients must provide a secure and level table for the cake(s) and ensure the environment maintains an optimal room temperature of 71°F or below. Cakes are heavy and require careful handling. Cakes should remain out of direct sunlight, away from open doors or windows, and on level ground until serving. Setup services include placement, minor touch-ups, and final presentation. Full table styling or décor is not included unless contracted separately. Tiered Kakes takes pride in every product made; any concerns must be addressed before leaving the premises. Once the cake leaves our possession, all sales are final.

Cakes should be stored in a cool, dry place and consumed as close to the event date as possible. Fondant cakes should not be refrigerated. Clients assume responsibility for proper storage, transport, and handling.

Products may contain or come into contact with milk, eggs, soy, wheat, gluten, peanuts, tree nuts, dyes, and flavorings. Tiered Kakes is not liable for allergic reactions. Clients assume full responsibility for serving and consumption. Tiered Kakes is not liable for bodily injury, indirect damages, or consequential losses.

Non-edible décor must be removed before serving. Clients assume liability if third parties cut the cake. Cake-cutting guides are estimates; actual servings may vary.

Tiered Kakes may photograph and use images of cakes for marketing without compensation. Professional photos may be credited if permitted by the photographer.

Refunds for disputes regarding design or production are at Tiered Kakes’ discretion and are not automatic. Full refunds will not be issued for cakes that have been consumed. Cakes delivered to venues are photographed for quality documentation. Tiered Kakes is not responsible for loss or damage to the cake or accompanying items such as stands, knives, or decorations once the cake has been delivered or collected.

Tiered Kakes shall not be held liable for delays or inability to deliver due to accidents, natural disasters, transportation issues, inclement weather, illness, hospitalization, death in the immediate family, acts of God, or other circumstances beyond our control. Delays do not constitute grounds for discounts, refunds, or other compensation.

If Tiered Kakes cancels an order for reasons other than nonpayment or Client cancellation, all payments, including non-refundable deposits, will be refunded in full. If the Client cancels at any time, all payments received, including non-refundable deposits, are forfeited.

By placing an order, submitting payment, or signing an agreement, the Client acknowledges that they have read, understood, and agreed to all Terms and Conditions stated herein.
